Express Convenience Centers GoFor RewardsŪ Terms and Conditions

Welcome to the Express Convenience Centers GoFor RewardsŪ program ("GoFor RewardsŪ" or "Program") These GoFor RewardsŪ terms and conditions of the agreement ("Agreement") between you ("You" and Your") and Express Convenience Centers, including , without limitation, U.S. Venture, Inc., its affiliates, officers, directors, employees, representatives, agents, successors, and assigns ("Company").

(1) Agreement to Terms. YOU AGREE TO READ CAREFULLY AND TO FOLLOW THESE TERMS AND CONDITIONS BEFORE USING THE GoFor RewardsŪ PROGRAM.  If You do not agree to these terms and conditions, You may not participate in the Program. Use of the Program signifies Your agreement to the terms and conditions of use set forth below.

(2) Modification of Agreement. Company reserves the right, at its sole discretion, to revise, change, modify, add, or remove any portion of the Program or this Agreement, in whole or in part, at any time.

(3) Point Accumulation/Obtaining Rewards. Points accumulate based on the value of gas and in-store items purchased.  Please visit us at www.ExpressGoForRewards.com or visit Your nearest Express Convenience Center for more information.  Rewards are subject to change without notice and at Company's sole discretion.  If a particular reward is not available, Company may in its sole discretion provide a substitute reward.

(4) Reward Expiration. All Point Rewards must be printed within 15 days of being earned and be redeemed within 15 days of being printed.  All Club Rewards must be printed within 30 days of being earned and be redeemed within 30 days of being printed.  Point Rewards and/or Club Rewards that are not printed or redeemed within the required periods will expire from Your rewards account(s) and will not be reissued or accepted for prize redemption, though your point totals will not be reduced. 

(5) Right to Change or Terminate the GoFor RewardsŪ Program.  Company may change, revise, suspend, or discontinue any aspect of the Express GoFor RewardsŪ program at any time or terminate the Program at any time.  Company may also impose limits on certain features and services or restrict Your access to portions of or the entire Program without notice of liability.  Company reserves the right, at its sole discretion, to refuse service or cancel membership at any time to anyone.

(6) Application and Key Tag.  You must complete and submit the GoFor RewardsŪ Participant Application in order to receive and use the GoFor RewardsŪ key tag which is necessary to participate in the Program.

(7) Indemnification for Your Breach of Agreement.  You hereby agree to indemnify, defend, and hold Company, and all of its affiliates, officers, directors, employees, representatives, agents, successors, assigns, information providers, licensors, and licensees (collectively, the "Indemnified Parties") harmless from and against any and all liabilities and costs incurred by the Indemnified Parties in connection with any claim arising out of any breach by You of the Agreement or the foregoing representations, warranties and covenants, including, without limitation, attorneys fees and costs.  You shall cooperate as fully as reasonably required in the defense of any claim.  Company reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by You, and You shall not in any event settle any matter without the written consent of Company.

(8) NO WARRANTY. THE GoFor RewardsŪ PROGRAM, INCLUDING ALL CONTENT, SOFTWARE, FUNCTIONS,MATERIALS AND INFORMATION MADE AVAILABLE TO YOU OR ACCESSED BY YOU, IS PROVIDED "AS IS." TO THE FULLEST EXTENT PERMISSIBLE BY LAW, COMPANY MAKES NO REPRESENTATION OR WARRANTIES OF ANY KIND WHATSOEVER FOR THE CONTENT OF THE PROGRAM OR THE MATERIALS, INFORMATION AND FUNCTIONS MADE ACCESSIBLE THROUGH THE PROGRAM.  FURTHER, COMPANY DISCLAIMS ANY EXPRESSED OR IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.  COMPANY ASUMES NO RESPONSIBILITY FOR, AND SHALL NOT BE LIABLE FOR ANY DAMAGES RESULTING FROM, USE OF THE PROGRAM AND ANY ITEMS OBTAINED THROUGH THE USE THE PROGRAM.  THE INDEMNIFIED PARTIES SHALL NOT BE LIABLE FOR THE USE OF THE PROGRAM, INCLUDING, WITHOUT LIMITATION, THE CONTENT AND ANY ERRORS CONTAINED THEREIN.  COMPANY SHALL NOT BE LIABLE FOR ANY FAILURE OF THE PROGRAM WHICH RESULTS FROM ACTS OR EVENTS BEYOND THE COMPANY'S REASONABLE CONTROL.

(9) NO AWARD OR DAMAGES AGAINST COMPANY. IN NO EVENT SHALL COMPANY BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL, OR OTHER DAMAGES ARISING OUT OF THE USE OF THE PROGRAM.  THIS INCLUDES, WITHOUT LIMITATION, LOST PROFITS, BUSINESS INTERRUPTION, DAMAGE TO EQUIPMENT, COMPUTER PROGRAMS, OR INFORMATION SYSTEM, OR THE LOSS OF ANY INFORMATION OR DATA.

(10) Excluded items. Points will not accumulate for the following purchases: Any and all ticket purchases, including, but not limited to, lottery and event tickets, money orders, Western Union Money transfers, third party services, and all other items and/ or services prohibited by law or which Company, in its sole discretion, may determine will not be eligible for GoFor RewardsŪ point accumulation. This list is subject to change without notice during the life of the program. 

(11) Lost, Stolen, Damaged Tags and Coupons/Unredeemed Points. Company is not responsible for and is not required to replace lost, stolen, or damaged tags or reward coupons, or for unredeemed points; however, these may be replaced at the sole discretion of Company.

(12) Place of Redemption. GoFor RewardsŪ rewards coupons may be redeemed at any participating Express Convenience Centers™ location, unless otherwise specified, so long as the reward item is available at the location.

(13) Valid Key Tag. You must present a valid GoFor RewardsŪ key tag to earn points. The key tag must be presented at the time of purchase.  Points will not be awarded without a valid GoFor RewardsŪ key tag or for previous purchases.

(14)Points Not Redeemable for Cash.  Points and/or reward coupons may not be redeemed or exchanged for cash.

(15) The GoFor RewardsŪ program may not be used in conjunction with any other offer or discount, or any other similar program, including but not limited to, the Fresh Brands/Piggly Wiggly Pig Points program.

POINT ACCUMULATION/REWARDS

Upon the submittal of Your application and agreement to the GoFor RewardsŪ Terms and Conditions, You may begin accumulating points and obtaining rewards as follows:

Point Rewards:

Points accumulate at a rate of 10 points per gallon of fuel purchased and 20 points for each dollar spent on non-fuel items. (Points do NOT accumulate for the purchase of items listed on the Excluded Items list above).  Rewards are earned based on the amount of points earned.  You will earn a reward (though you may not receive the award if rewards are not printed or redeemed within the required time periods) for every 500, 2000, and 10,000 points earned.  This means that every time You reach a 10,000 point threshold (10,000; 20,000; etc.) You will have earned 20 - 500 point rewards, 5 - 2000 point rewards and 1 - 10,000 point reward, for a total of 26 rewards.

 

Benefits are as listed below:

Point Rewards: You will receive in the store a coupon for either an in-store item or an item provided by one of the Company's GoFor RewardsŪ supporting businesses rewarding You for Your point achievement.  The type and value of coupon provided will be at the Company's sole discretion. 

Sweepstakes Entries: In addition, You will also be eligible for automatic entry into a sweepstakes offered by Company.  Every time You swipe Your Key Tag you will earn an entry into the next sweepstakes.

The sweepstakes is open to all eligible participants and is not limited to GoFor RewardsŪ participants.  No purchase is necessary to enter the sweepstakes. Contact Your local Express Convenience Centers™ store for additional details.

Club Rewards:

Club Rewards gives You the chance to earn free rewards for Your loyalty to a particular brand or product.  An example of a Club Reward would be a "buy 10, get 1 free" deal.  Club Rewards are offered on an individual basis by vendors of Company and are subject to change or discontinue at any time with no further commitment to You or the GoFor RewardsŪ program.  Please see the Club Rewards flyer at Your nearest Express Convenience Center for participating vendors.  Club Reward credits will transfer from one month to the next.  Club Reward credits may not be transferred to any other party.
